O R D E R

Apprehending arrest in connection with Crime No.337 of 2024 registered for the offences punishable under Sections 316(2) and 318(4) of BNS, 2023, the present petition has been filed seeking anticipatory bail.

2. Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this court. He would submit that the petitioner was running a travel agency and due to financial difficulties, he was unable to pay the interest payment to the lenders. Subsequently, some of the lenders had filed a false complaint against the petitioner, including the defacto complainant. He would submit that the other

accused had taken all the cars from the petitioner. He would further submit that the petitioner is ready to abide by any stringent condition that may be imposed by this Court.

3. The case of the prosecution as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of anticipatory bail, is that, the petitioner induced the defacto complainant in the guise of taking his car on lease and thereafter he had not given the lease amount and not returned the car, later, absconding. He would submit that apart from this case, 9 complaints of similar nature was pending against the petitioner and a case in Crime No.343 of 2024 was filed before the Kavundampalayam Police Station,

Heard the learned counsel for the petitioner, the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record, considering the fact that 9 complaints of similar case was pending against the petitioner and one previous case pending in Kavundampalayam Police Station, this court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, this Criminal Original Petition is dismissed. 24.01.2025
