O R D E R
The petitioner, who was arrested and remanded to judicial custody on 21.07.2025, for the offences punishable under Sections 5 of Explosive substance Act, 1908 r/w Section 9(B)(1)(b) of Indian Explosives Act in Crime No. 312 of 2025, on the file of the respondent police, seeks bail. 1/4

The case of the prosecution is that on 21.07.2020, at about 6.50am, based on the secret information, the respondent police went to Hosur Rayakottai road and intercepted the vehicle bearing registration No.TN 04 AK 5550 and found that petitioner was in illegal possession of 824 gelatin sticks named Sun-90 (25mm) and 550 electronic detonators. Hence, the case.

Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case, however, he is suffering incarceration from 21.07.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner 4.
The learned Government Advocate (Crl. Side) appearing for the respondent, while opposing for grant of bail to the petitioner, reiterated the prosecution case and submitted that this is a 3rd bail application and the earlier bail applications were dismissed by this Court in Crl.O.P.Nos.21850 and 24589 of 2025 and there is no change of circumstances in this case. He also submits that there are four previous cases pending against this petitioner out of which three were similar in nature. Hence, he opposed to grant bail to 2/4
the petitioner.

Considering the facts and circumstances of the case, the allegations against the petitioner, submissions made by the learned counsels on either side, considering the fact that this is a 3rd bail application and there is no change of circumstances in this case, this Court is not inclined to grant bail to the petitioner.
