ORDER

The petitioner apprehends arrest for the alleged offence under Sections 303(2), 326(a) of BNS Act r/w. 21(1) of Mines and Minerals (Development and Regulations) Act in Crime No.149 of 2025, on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that, at the instigation of A2, the petitioners had transported river sand in four vehicles without a valid permit from the competent authority. It is further alleged that the petitioners, who were the drivers of the said vehicles, absconded along with three lorries bearing Registration Nos.TN 73 L 9009, TN 30 BP 0677, and TN 75 B 6825, leaving one Hitachi vehicle at the place of occurrence. Hence, the complaint.

3. The learned counsel for the petitioner submitted that already arrested accused have been released on bail and this petitioner has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that this Court has already considered and dismissed the bail applications of A1, A3 and A6.

5. I have also gone through the earlier order. It was found that the petitioners used heavy machinery and the investigation is not yet complete. Hence, this Court is not inclined to grant anticipatory bail to the petitioners.
