O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 281, 125(a) under BNS Act, 2023 in Crime No.409 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that this petitioner driven the goods vehicle in rash and negligent manner and hit on the two-wheeler in which the deceased were travelled which resulted in causing severe injuries to the persons travelled in a two-wheeler and subsequently, two persons were died. Hence the case.

3. The learned counsel for the petitioner submitted that the victim has come in the opposite direction without care and caution, suddenly entered into the road which resulted in causing accident. He further submitted that he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and reported that it is a case of death, by negligent act of the petitioner herein who drove the vehicle in rash and negligent manner and he produced the rough sketch on the place where the accident had taken place.

5. I have also considered the submissions made on both sides and also the materials available on record.

The rough sketch produced by the police reveals that the pickup vehicle driven by the petitioner on the right side of the road (Opposite direction) which has caused triple death and further there are allegations that this petitioner has driven the vehicle on very high speed. Considering the above, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition stands dismissed. 06.10.2025 ssi To:
