ORDER

This writ petition has been filed for issue of writ of mandamus directing respondents 1 to 3 to consider the representation made by the petitioner on 27.03.2025, wherein, the petitioner is seeking for rectification of the extent for which patta was granted in favour of the 4th respondent and to restore that extent of the property to the petitioner by issuing a fresh patta. 2.Heard Mr.M.Ramamoorthi, learned counsel appearing on behalf of the petitioner and Mr.D.Ravichander, learned Special Government Pleader appearing on behalf of respondents 1 to 3.

3/6 3.In the considered view of this Court, the petitioner is aggrieved by the patta that was issued in the name of the 4th respondent to an extent of 0.12 cents instead of 0.03 cents and according to the petitioner, the extra extent of property was taken away from the property that belongs to the petitioner. If the petitioner wanted an enquiry to be conducted, the petitioner should have filed an appeal before the concerned Revenue Divisional Officer. The District Collector cannot deal with this issue, since the District Collector has not been vested with such a power under the Patta Pass Book Act.

4.In view of the above, the liberty is granted to the petitioner to make a fresh representation before the Revenue Divisional Officer along with all the relevant documents and also a copy of this order. On receipt of the same, the Revenue Divisional Officer shall conduct an enquiry after affording an opportunity to the 4th respondent and final orders shall be passed, within a period of eight weeks from the date of receipt of the fresh representation/appeal from the petitioner.
