ORDER

The petitioner, who was arrested and remanded to judicial custody on 07.09.2025, for the offences punishable under Sections 7(5), 20(2) of COTPA Act, 2003 r/w. Section 123 of BNS in Crime No.325 of 2025, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that on 07.09.2025, while the respondent police were on their routine patrol and inspection duty, they found that the petitioner along with other accused was involved in illegal transportation of 571 kilograms of banned tobacco products such as Hans, Swagath, Cool Lip, Vimal and V-1 valued nearly about Rs.5,71,000/-. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner was falsely implicated in this case and he is in judicial custody since 07.09.2025 and the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that huge quantity of contraband involved in this case; that the petitioner herein is arrayed as A1 and the detention of the petitioner under Goondas Act is under progress; and that the investigation is pending.

Considering the facts, gravity of offence, huge quantity of contraband involved in this case and the fact that the investigation of this case is pending, this Court is not inclined to grant bail to the petitioner. 6.
