ORDER

This Criminal Appeal has been filed by the appellant, to set aside the order dated 01.08.2025 in Crl.M.P.No.1381 of 2025 on the file of the Principal district and sessions Judge, Kancheepuram and to enlarge the appellant/accused on bail in connection with the Crime No.20 of 2024 on the file of the respondent police.

The appellant herein is the accused in Crime.No.20 of 2024 for the alleged offence under sections 376(2)(n), 417 of IPC @ 417 of IPC, 376(2)(n), r/w.3(1)(r), 3(1)(s), SC/ST (POA) Act @ 376(1), 506(i) IPC & section 3(1)(r), 3(1)(s), 3(1)(w)(i), 3(1)(w)(ii), 3(2)(v), 3(2)(va) SC/ST Act. Thereafter,

investigation has been completed and charge sheet was laid and the case was numbered as S.C.No.53 of 2025 on the file of Principal District and Sessions Judge/Special Judge for the exclusive trial of cases under the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act 1989, Kancheepuram.

3. The appellant has filed Crl.M.P.No.1381 of 2025 before the Special Court, Kancheepuram and sought for bail for 5 th time. However, the said Court dismissed the bail application. Against which, the present appeal has been filed. 4.

The learned counsel for the appellant would submit that the appellant was implicated in this case as if he has given false promise and refused to marry the defacto complainant and he is ready to abide the condition imposed by this Court.

5. On notice issued by this court to the defacto complainant, she appeared before this court along with her child. As on date, there is possibility of settling the issue. Therefore, the defacto complainant has not raised any

objections as regards grant of bail to the appellant. Further, the defacto complainant would submit that she would pursue the main issue through her counsel and in this regard, she also submitted an affidavit before this Court that she has no objection in granting bail to the appellant and there is possibility of settling the issue amicably between them.

6. Considering the submissions of the defacto complainant as well as taking note of the nature and facts of the present case, this Court is inclined to grant bail on the following conditions:

(a) the appellant/accused is ordered to be released on bail, on executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, in which one surety must be a blood related surety, each for a like sum to the satisfaction of the learned Principal District Session, Principal District and Sessions Court, Kancheepuram District. (b) The petitioner/accused and the sureties shall affix their photographs and Left Thumb Impressions in the surety bonds and the Magistrate may obtain a copy of their Aadhaar Cards or Bank Pass Books to ensure their identities.

(c) The petitioner shall appear before the Trial Court as and when required.
