ORDER
The relief sought for in this writ petition is to call for the records pertaining to the impugned Refusal Check Slip in Refusal No.RFL/Gandhipuram/25/2025 dated 29.08.2025 issued by the second respondent, quash the same and consequently direct the second respondent to register the Court Decree dated 09.09.2019 passed in A.S.No.9 of 2019 by the Learned Principal Subordinate Judge, Coimbatore.
2. Mr.U.Baranidharan, learned Special Government Pleader takes notice on behalf of the respondents. By consent of both the parties, this writ petition has been taken up for final disposal at the stage of admission itself.
3. Learned counsel for the petitioner would submit that the 2/6
petitioner has purchased a property comprised in S.Nos.579/1 and 579/2, Kalapatti Village, Coimbatore, measuring 2.30 acres and 1.52 acres respectively. This being so, one Mr.Shanmugam attempted to trespass the aforesaid property, hence the petitioner filed a civil suit, seeking permanent injunction and the same was dismissed. Challenging the same, the petitioner has preferred an appeal, wherein the suit was decreed in favour of the petitioner. Under these circumstances, the petitioner presented the said Court Decree dated 09.09.2019 for registration, the second respondent refused to register the same on the ground that there was a multiple entries and unable to identify the land owner. Challenging the said refusal, the petitioner has come forward with the present writ petition.
4. Learned Special Government Pleader appearing for the respondents fairly submitted that since, it is a Court Decree, the respondents cannot stand in a way of registering the same. Hence, he would submit that appropriate orders passed within a time frame that may be fixed by this Court.

5. Heard the learned counsel on either side and perused the materials available on record.

This Court is of the view that the respondents certainly cannot stand in the way of registering the Court Decree dated 09.09.2019, citing the reason that the ownership was not established and the respondents are bound to register the same without raising any queries, unless and otherwise, if they doubted on the aspect of obtaining decree itself.
7. In the present case, there is no dispute on the aspect of genuinity of the decree. Such being the case, the respondents are bound to register the same and rejecting the registration of the Court decree is illegal. For the foregoing reason, this Court feels it would be appropriate to set aside the impugned order dated 29.08.2025 passed by the second respondent. Accordingly, the said order is set aside. Consequently, the second respondent is directed to register the Court decree dated 09.09.2019, immediately upon the re-presentation of the same by the petitioner. In the result, this writ petition stands allowed. No costs. 4/6
