O R D E R
This application has been filed seeking a direction to the Registrar General to endorse and hand over the fixed deposit receipt 2/5
bearing No.TBM/TDR/2009/325801, Account No.75120300003887, dated 10.09.2024 drawn on Bank of Baroda, Venkatanarayana Road, Chennai for a sum of Rs.1,04,98,917/- together with interest if any in favour of the applicant.
2. Heard Mr.Vijayan Subramanian, learned counsel for the applicant.
3. In pursuance of the order dated 08.11.2023, the applicant herein was directed to produce term deposit for a sum of Rs.1 crore in favour of the Registrar General of this Court. It was specifically mentioned that the said amount would be treated the security for a period of two months from the date of the order. Thereafter, the parties were referred to arbitration.
4. It is seen that on 25.06.2024 before the Arbitration Tribunal, the order has been passed recording the Joint Memorandum filed by the parties to withdraw the claim as well as counter claim. The order also contemplates the applicant herein to withdraw the amount deposited before this Court and no objection for such withdrawal of the claims in the arbitration case has also been recorded.
5. The learned counsel for the applicant across the bar would 3/5
also state that the applicant is represented by Power Agent. The Photostat copy of the Power of Attorney is also filed in the typed set of papers. The learned counsel for the Applicant further states that it is the power agent who conducted the proceedings before the Arbitration as well.
6. In view of the above, I do not see any impediment for the application being ordered as prayed for.
7. Accordingly, this application is allowed and the Registry shall hand over the original term deposit to the Power Agent viz., Mr.T.Rajhentherr.
