Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents 1 to 3 to consider the petitioner's representation dated 25.11.2024 request not to levy house tax to the buildings of 4th and 5th respondents which is located within 300 meters from the stone quarry of the petitioner. O R D E R

The Writ Petition has been filed in the nature of a Mandamus seeking a direction against the 1st, 2nd and 3rd respondents to consider the representation dated 25.11.2024 given by the petitioner. By that representation, the petitioner had sought that the property of the 4th and 5th respondents should not be subjected or assessed to tax.

2.The grievance of the petitioner is that the 4th and 5th respondents have deliberately put up a few constructions in the nature of cattle shed close to the quarry run by the petitioner. It is contended that if the said constructions are authorised and approval is granted and assessed to property tax, then there would 2 / 5

be an objection for the petitioner to continue doing his business in quarry. The petitioner had given necessary representation in this regard. 3.A direction is issued to the 2nd respondent, Block Development Officer, Pollachi, Coimbatore District, to issue notice to the petitioner and also to the 4th and 5th respondents and examine the representation of the petitioner. The 2nd respondent may examine the date from which the quarry is functioning and the date on which the 4th and 5th respondents had put up their respective constructions and thereafter pass necessary orders on the representation of the petitioner herein. Such exercise should be completed on or before 31.03.2025. 4.The Writ Petition stands disposed of . No costs. 07.01.2025 Index : Yes/No NCS : Yes/No KP 3 / 5
