ORDER

The petitioner/accused, who is facing trial in S.C.No.205 of 2022 for offence under Sections 306, 376, 417 & 506(i) of IPC before the Additional Page No.1 of 6

Mahila Court, Magistrate Level at Chengalpet, has filed this Criminal Original Petition on the ground of compromise. 2.Case of the prosecution is that the 2nd respondent completed B.Com., in SIET College, Vengaivasal, Chennai. While studying in college, the 2nd respondent stayed in her brother's house. At that time, the 2nd respondent fell in love with the petitioner. Citing the community, both the family members of the petitioner and the 2nd respondent were not inclined for their marriage. Thereafter, the petitioner had gone to the 2nd respondent's house on several occasions when the 2nd respondent's mother was not there and had physical relationship. Added to it, the petitioner bought various pills to prevent the 2nd respondent from getting pregnant. On 20.01.

2021 in the morning, when the 2nd respondent called the petitioner through mobile phone, the petitioner's father picked up the call and threatened the 2nd respondent not to make any call to the petitioner hereafter. Knowing that the 2nd respondent was cheated, the 2nd respondent consumed oleander seeds, thereafter with the help of the family members, the 2nd respondent admitted in Karpaga Vinayaga Hospital for treatment. On receipt of the complaint, the 1st respondent Police registered an FIR in Crime No.1 of 2021 for offence under Sections 306, 376, 417 & 506(i) IPC against the petitioner. Page No.

On completion of investigation, charge sheet filed before the trial Court in S.C.No.205 of 2022 listing LW1 to LW20 and documents. Challenging the same, the present petition is filed.

3.The case is at the stage of trial. By passage of time, the parties have decided to bury their hatchet and compromise the dispute amicably among themselves.

4.Today the petitioner and the 2nd respondent appeared before this Court and their identity is confirmed by Ms.V.Malarvizhi, Women Special Sub Inspector attached to the 1st respondent Police Station. This Court also enquired both the parties and was satisfied that the parties have come to an amicable settlement between themselves. The 2nd respondent informed that she and the petitioner got married at Sri Nagakanniyamman Putru Kovil, Thiruverkadu, Chennai on 30.10.2022 and they are leading a happy married life. She further informed that she is not willing to further proceed with the case and filed an affidavit to that effect. The petitioner and the 2nd respondent have filed separate affidavit before this Court and also filed Joint Compromise Memo.

5.Under such circumstances, no useful purpose will be served in keeping the First Information Report pending, even though, the offences involved are not compoundable in nature. In the light of the guidelines given by the Hon'ble Supreme Court reported in 2017 9 SCC 641- (Parbathbhai Aahir @ Parbathbhai Vs. State of Gujrath), and after exercising due caution as advised by the Hon'ble Suprme Court in The State of Madhya Pradesh v. Dhruv Gurjar and Another reported in (2019) 2 MLJ Crl 10), this Court in exercise of its jurisdiction under Section 482 Cr.P.C., is inclined to quash the proceedings in S.C.No.205 of 2022 on the file of the Additional Mahila Court, Magistrate Level at Chengalpet, 6.This Criminal Original Petition stands allowed and as a sequel, the proceedings in S.C.No.205 of 2022 on the file of the Additional Mahila Court, Magistrate Level at Chengalpet is quashed against the petitioner. 16.03.2026 Index: Yes/No Speaking Order/Non-Speaking Order vv2 Page No.4 of 6
