O R D E R

This Criminal Original Petition has been filed to grant leave to file an appeal against the judgment of acquittal of the learned Judicial Magistrate, Kangeyam made in S.T.C.No.41 of 2021 dated 02.03.2024.

2. Learned counsel for the petitioner submitted that the petitioner has filed the complaint against the respondent before the learned Judicial Magistrate, Kangeyam in S.T.C.No.41 of 2021, for the offence under Sections 138 and 142 of Negotiable Instruments Act. The learned Magistrate vide order dated 02.03.2024, acquitting the respondent/accused. Aggrieved over the same, the petitioner has filed the criminal original petition seeking leave to file an appeal.

3. Learned counsel for the respondent would submit that there is no perversity in the order passed by the Court below.

4. Heard the learned counsel on either side and perused the grounds of appeal.

5. Since there are arguable points in the grounds of appeal, leave is granted.

6. Registry is directed to take the appeal on file, if it is otherwise in order.

7. Learned counsel for the petitioner is directed to serve copy of grounds of appeal and other relevant papers if any, to the counsel for the respondent on record.
