ORDER

This Criminal Original Petition has been filed to issue directions to the respondent not to harass the petitioner and his peaceful life under the guise of enquiry.

2. The case of the petitioner is that the petitioner is a pawn broker. While so, one Chitra pledged two grams of gold coin during June, 2025, however, the respondent police alleges that the said Chitra committed theft from the house of one Sriram, thereby pledged 13 sovereign of gold ornaments, though the day to day ledger book was shown to the respondent police in support of the contention of the petitioner, the respondent police is harassing the petitioner and threatening him with dire consequences. Hence, this petition.

3. The learned Additional Public Prosecutor, on instructions submitted that current paper enquiry is pending against the petitioner and the petitioner was called for enquiry and the respondent has not harassed the petitioner.

4. In such view of the matter, it is for the investigating agency to issue appropriate notice to the petitioner under Section 35(3) of BNSS for enquiry and on such notice, the petitioner shall appear for enquiry and co-operate with the investigation. If any cognizable offence is made out, the respondent shall register the First Information Report and proceed as per law. 2/4

5. With the above direction, this Criminal Original Petition is disposed of.
