O R D E R
This writ miscellaneous petition (criminal) has been filed seeking to restore the writ petition in WP.Crl.No.14569 of 2024, which came to be dismissed for non-prosecution on 22.08.2025.
2. Learned counsel for the petitioner submitted that due to some medical emergency, he could not appear before this Court on 22.08.2025. However, without affording an opportunity and without listing the matter under the caption 'for dismissal', this Court, vide order dated 22.08.2025 had dismissed the main writ petition for non-prosecution, which is not sustainable. He further submitted that his non-appearance on the said date was neither wilful nor wanton and hence, this petition may be allowed.
3. Heard the learned counsel on either side and perused the materials available on record.
4. Satisfied with the reasons stated in the affidavit filed in support of this petition, this Court is inclined to allow this petition.
5. Accordingly, this writ miscellaneous petition (criminal) stands allowed and the main writ petition in WP.Crl.No.14569 of 2024 is restored to file.
6. Registry is directed to post the main case in the usual course. 11.12.2025 skt To 1.
