ORDER
This Court in W.P.No.30093 of 2024, considering the prayer of the writ petitioner has passed the following order:- "The petitioner herein claiming as Chairman and Treasurer of Sri Sarangapani Swamy Ramanujam Pillai Garuda Vahana Trust is before this Court seeking issuance of writ of mandamus for providing police protection based on his representation dated 14.07.2021 and 13.08.2024.
2. The learned Government Advocate (Crl.Side) appearing for the respondent police submits that the representation from one Kalaiarasan been received and registered as C.S.R.No.537 of 2024. However, the relevant documents relied by the petitioner for police protection not produced. Hence, CSR was closed. He further submits that if the petitioner or his representative produce all the relevant documents before the third respondent, necessary action will be taken on the representation.
3. Taking note of the fact that the petitioner after seeking police protection based on the order passed by this Court in W.P.No.20779 of 2021 had presumably not participated in the enquiry. Hence, it is sufficient to direct the petitioner herein to appear before the third respondent in person or through his representative and produce all the documents relevant for the relief sought and if the petitioner has any right for protection in discharging his duty as Treasurer of the said trust, the respondent police shall provide the same."

Alleging that the respondent has not given protection as directed and did not conduct an enquiry, the contempt petition was filed and taken on file by this Court. Before proceeding further in the contempt petition, this Court directed the contemnor to file an affidavit regarding the action taken pursuant to the order passed by this Court.

The Inspector of Police, Kudavasal, has filed an affidavit stating that an enquiry was conducted and on receipt of the report from the Tahsildar and considering the fact that O.S.No.73 of 2014 pending before the District Munsif Court-cum-Judicial Magistrate, Kudavasal, he thought fit it appropriate that the parties work out their remedy before the civil Court, as the police cannot be interfered in a civil dispute. He has also tendered unconditional apology for any lapse on his part in implementing the Court order. 4.
Without going into merits of the conclusion of the contemnor regarding the position, I am inclined to close the contempt petition on the ground that the petitioner has to workout his remedy in the civil suit pending before the District Munsif Court-cum-Judicial Magistrate, Kudavasal. 5.
As a result, this Contempt Petition is closed. Consequently, the connected Sub Application is also closed.
