ORDER
This writ petition has been filed challenging the online rejection order of the second respondent and for a consequential direction to respondents to conduct survey in the subject property.
2. Heard Mr.J.Pradeep, learned counsel for petitioner and Mr.D.Ravichander, learned Special Government Pleader appearing for respondents.
3. The petitioner is claiming ownership over the subject property by virtue of a registered sale deed dated 10.03.2025. The petitioner further claims that patta has been issued in his name in patta No.1954 for the subject property. The petitioner submitted an application seeking for survey of the property. The petitioner was informed through SMS that the survey cannot be conducted since patta does not stand in his name. Aggrieved by the same, the present writ petition has been filed.
4. In the considered view of this Court, if the respondents want to get clarity from the petitioner on the availability of patta in the name of the petitioner, the petitioner should have been called for enquiry. This is more so since the patta stands in the name of the petitioner for the 2/4
subject property in patta No.1954. Therefore, the rejection of the application through SMS is illegal and is in violation of principles of natural justice.

In view of the above, the rejection order passed by the second respondent is set aside and the matter is remanded to the file of the second respondent and the second respondent is directed to conduct survey based on the title document and the patta that has been issued in favour of the petitioner and complete the said process within a period of four (4) weeks from the date of receipt of a copy of this order. If there are any other interested parties, such survey shall be conducted in their presence.
