This Writ Petition has been filed challenging the order dated Nil passed in Application No.TN.720250417306 and for a consequential direction to the respondent to issue Legal Heir Certificate of the petitioner's brother Vijayakumar in favour of her.
2. The case of the petitioner is that the petitioner's brother, namely, Vijayakumar, who was unmarried, died on 31.03.2025, for which, the petitioner made an application for issuance of Legal Heir Certificate before the respondent and it was rejected without assigning any reason. Challenging the same, the present Writ Petition has been filed.
3. The learned Additional Advocate General appearing for the respondent would submit that this Court may set aside the impugned order and remand the matter back to the respondent for fresh consideration in accordance with G.O.(Ms).No.110 dated 13.03.2024.
4. Heard the learned counsel appearing for the petitioner and the learned Additional Advocate General appearing for the respondent.
5. Since the impugned order has been passed by the respondent without assigning any reason, the impugned order dated Nil passed in Application No.TN.720250417306 by the respondent is set aside and the respondent is directed to consider the matter afresh in accordance with G.O.(Ms).No.110 dated 13.03.2024.
6. Accordingly, this Writ Petition is allowed. There shall be no order as to costs. Connected miscellaneous petition is closed. 07.10.2025 NCC: Yes / No Index : Yes / No Speaking Order : Yes / No ssb
