ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 303(2) of BNS Act, 2023 r/w Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.440 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner along with others illegally quarrying 1/4 unit of river sand from the Kedivalam river in bullock cart without any valid licence or permit. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that he is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and reported that investigation in this case is still pending and one previous bad antecedents registered against him. Hence, he opposed to grant anticipatory bail to the petitioner.

Considering the facts and circumstances of the case, taking note of the submission made by the learned Government Advocate (Crl.Side), the nature of allegation and his previous bad antecedents and since the petitioner attempted to take the river sand by using bullock cart, causing severe damage to the ecology and water body, this Court is not inclined to grant anticipatory 2/4

bail to the petitioner.
