ORDER

The petitioner, who was arrested and remanded to judicial custody on 09.09.2025, for the offences punishable under Sections 324(4) & 351(3) of BNS R/w Section 3 of Tamil Nadu Public Property (Prevention of Damage & Loss) Act, 1992 in Crime No.343 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that on account of previous enmity, the petitioner had pelted stones in the defacto complainant's house; that thereby broke the glass of her vehicle and threatened her with dire consequences. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner is the neighbour of the defacto complainant and due to a wordy quarrel with regard to the boundaries of the house, there was a wordy quarrel; that subsequently, a false complaint was lodged against the petitioner. He further submitted that the petitioner is in judicial custody since 09.09.2025 and the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. 2/4

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the petitioner has six previous cases; and that the investigation is pending.

Considering the facts, gravity of offence, the previous antecedents of the petitioner and the fact that the investigation of this case is pending, this Court is not inclined to grant bail to the petitioner. 6.
