ORDER
This application has been filed to receive a reply statement by alleging that the written statement filed by the defendant contains several allegations against the plaintiff.
2. The suit filed is a testamentary original suit, having a limited scope to prove the genuineness of the Will dated 16.04.2019.
3. Both the plaintiff and the defendant are at liberty to cross-examine the respective witnesses with regard to the allegations made against each other. However, what is relevant in a testamentary suit is only the genuineness of the Will. Hence, even without filing any reply statement, the facts relevant to the suit can be proved by the plaintiff.
4. Permitting the filing of a reply statement as if it is a title suit, would only result in unnecessary delay and might invite further pleadings from the other side.
5. Hence, the application is dismissed.
