ORDER
This Civil Revision Petition is arising against the order passed by the learned Principal District Judge, Chengalpattu, in I.A.No.2 of 2023 in O.S.No.503 of 2023 dated 01.10.2024.
2.
I.A.No.2 of 2023 was an application seeking direction to the defendants to pay rents pending the suit. The suit is one for ejectment. When the matter came up for admission, Mr.M.Sachin Vijay, relying upon the judgment of this Court in Talasila Asha Vs. S.Adhikesavan, 2023 SCC OnLine Mad 8087, claimed that the petitioner is entitled for a direction to pay the rents pending disposal of the suit. Considering the precedent cited, this Court permitted Mr.M.Sachin Vijay to serve notice on the counsel who represents the defendant in the Court below. Notice has been served, and Mr.Stephen C. Kumar entered appearance for the respondents. 3.
When I took the revision for disposal, both Mr.M.Sachin Vijay and Mr.Stephen C. Kumar represented that the parties have amicably settled the issues between them. They filed Joint Compromise Memo which has
been received by this Registry in S.R.No.2322 dated 21.01.2025. The terms of the compromise are recorded hereunder :-
4.
I have gone through the memo of compromise and it has been signed by the parties as well as the respective counsels. I do not find any
illegality or irregular in the compromise. The land lord decided to waive his rental arrears, if the possession has been handed over to him on or before 20.02.2025.
5.
Recording the same, the Civil Revision Petition is disposed of. The learned Principal District Judge, Chengalpattu, is requested to record this order and a pass decree in the suit. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs. 21.01.2025 Index : Yes/No : Yes/No Speaking order/Non-speaking order rts To
