Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue Writ of Mandamus, to direct the 1 st respondent to consider the petitioner's representation dated 01.09.2025 whereby requesting the 1st respondent to take preventive steps with respect to the 6th respondent's illegal prayer meet and construction of prayer hall in the residential area without obtaining proper permission from the concerned authorities and consequently, to enforce the order dated 21.02.2023 in Na.Ka.A2/111/2023 issued by the Tahsildar.

2.The case of the petitioners is that they are the residents of Sriram Nagar at C.Dhandeswaranallur and they purchased Plot Nos.16, 24 and 7 respectively th respondent, has and constructed a house there. For the past five years, the 6 been operating a prayer hall in his house located at Plot No.19, just opposite to the petitioners' house. This activity, conducted under the guise of constructing a residence, constitutes a public nuisance due to the loud noise generated from collective prayers. Therefore, the petitioners lodged several complaints with various authorities namely, the Deputy Superintendent of Police, the Chidambram Tahsildar, the Sub Collector, the Revenue Inspector and the Village Administrative Officer.

Despite the official inquiries and reports confirming the illegal activity, the respondents have failed to take any permanent action. Subsequently, the 6th respondent continued with the unauthorised construction of a church and has been using electricity illegally. Aggrieved by the same, the petitioners and other residents made a complaint to the District Collector, the 1st respondent herein on 01.09.2025. But, the same was not considered till date. Hence the present writ petition has been filed.

3.The learned counsel for the petitioners would submit that it would suffice, if a direction is issued to the 1st respondent to consider the petitioners' representation within a reasonable time.

4.Since no adverse order has been passed against the 6th respondent, th respondent is dispensed with.

notice to the 6 5.Considering the facts and circumstances of the case, this Court is inclined to direct the 1st respondent to depute the officials to conduct an enquiry in between the petitioners and the 6th respondent, after affording an opportunity of personal hearing to both the petitioners and the 6th respondent and pass appropriate orders on merits and in accordance with law, within a period of four

(4) weeks from the date of receipt of a copy of this order. 6.With the above directions, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 5/9
