ORDER

The learned counsel for the petitioner submitted that as per the orders of this Court dated 10.03.2022 in Crl.M.P.Nos.3131, 3132 and 3134 of 2022 at Para 4, this Court directed the petitioner to deposit Rs.20 lakhs in C.C.No.3129 of 2020 on the file of the learned Metropolitan Magistrate, CCB, CB-CID Court,

Egmore Chennai. Thereafter, final report was filed in C.C.No.3129 of 2020. The trial was conducted and ended in acquittal on 24.09.2024. Therefore, he seeks to withdraw the said amount.

2.The learned counsel for the intervener raised objections stating that the the appeal in C.A.No.840 of 2024 is pending. The worth of the property is Rs.1.5 crores.

3.According to the prosecution, the intervener received Rs.20 lakhs as a part of the sale consideration and thereafter, sold the property to the third party for Rs.5 crores. Therefore, as on date, the property was sold to the third party and the defacto complainant was put into street and he is unable to collect the amount.
