With the consent of the learned counsel appearing for the petitioner and the learned Additional Advocate General appearing for the respondents, this Writ Petition is disposed of at the admission stage itself.
2. This Writ Petition has been filed challenging the rejection of the first petitioner's application No.TN-720250711498 dated 11.07.2025 vide order dated 06.08.2025 by the third respondent and for a consequential direction to the third respondent to issue a Legal Heir Certificate of late Mr.Mohanasundaram.
3. The learned counsel appearing for the petitioner would submit that the petitioners' father, namely, Mohanasundaram, who was working as Driver in the Corporation of Chennai, got retired in the year 2017 and died in the year 2024. However, prior to that, the mother of the petitioners had eloped with unknown person. While so, the petitioners have made an online application on 11.07.2025 for issuance of Legal Heir Certificate and the same was rejected on the ground that the details of the wife of the deceased was not submitted. In fact, the petitioners did not know their mother's name and on their tender age, their mother eloped with some other person and therefore, forcing the petitioners to give the details of their mother is not sustainable one and the respondents have to verify whether the petitioners are the legal heirs of the deceased Mohanasundaram. Without verifying the above aspects, the third respondent has rejected the application of the petitioners. Hence, the petitioners are before this Court.
4. The learned Special Government Pleader appearing for the respondents would submit that the Legal Heir Certificate will be issued to the petitioner within a period of two weeks.
5. Recording the submission made by the learned Special Government Pleader appearing for the respondents, this Writ Petition is disposed of directing the respondents to issue Legal Heir Certificate to the petitioners within a period of two weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Connected miscellaneous petition is closed.
