O R D E R

The petitioner, who was arrested and remanded to judicial custody on 24.08.2025, for the offences punishable under Sections 194 of BNSS @ 103(1), 238(A) of BNSS, 2023, in Crime No.296 of 2025, on the file of the respondent Police, seeks bail.

2. The case of the prosecution is that the petitioner, along with other accused, developed previous enmity with the deceased, who was also working with them and on 22.08.2025, while the deceased was sleeping, after consuming liquor, accused had strangulated the deceased and committed the murder. Thereafter taken the body and dumped it in road side.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case, and he has been in custody since 24.08.2025. The petitioner is ready and willing to abide by any conditions that may be imposed by this Court hence, he prays to grant bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and opposed the grant of bail to the petitioner, submitting that the investigation in this case is not yet completed.

5. Heard the learned counsels on either side and perused the materials available on record.

6. Considering the overt act of the petitioner and the fact that investigation in this case also pending, and the gravity of the offences, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this criminal original petition stands dismissed. 26.09.2025 cda 3/4
