When the matter is taken up for hearing today, learned Government Advocate (Crl.Side) appearing for the respondent submitted that the case has been registered for the offence under Section 296 (b) and 115 (2) of BNS Act is a bailable offence.
2. In reply, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw this petition with liberty to approach the concerned Magistrate Court and he has also made an endorsement to that effect.
3. In view of the submissions and the endorsement made by the learned counsel on either side, this Criminal Miscellaneous Petition is dismissed as withdrawn with liberty to approach the concerned Magistrate Court.
