ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This occurrence took place on 05.10.2004. It can be seen that the deceased victim, in respect of a dispute of a sum of Rs.4,000/-, had bet the sister of the accused. Enraged by it, in a sudden provocation, the accused went and hit the deceased and he died. In respect thereof, already, the case was faced by the first accused and in the mother case, S.C.No.6 of 2008, the accused after full fledged trial, was acquitted. Warrant is pending against the other accused, who is none other than the son. He is unheard off and could not be served.

3. In view of the long pendency and considering the overall background and circumstances, the case in P.R.C.No.100010 of 2007 of Judicial Magistrate Court, Dharapuram, Dharapuram Taluk, Tiruppur, stands quashed. This Suo Motu Transfer Case is disposed of.

26.09.2025 grs electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
