ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This is a case of murder. The occurrence happened on 24.07.2005. It can be seen that inside a factory, there was a wordy quarrel, pursuant to which, the accused is said to have attacked the deceased and he died. The other accused faced the trial and was also convicted and after conviction, he also died. It is seen that even P.W.1 has also died. As far as this accused is concerned, even at the time of filing charge sheet, an absconding charge sheet was filed and summons were never served. Therefore, considering the extraordinary nature of the case, there is no use in keeping the matter pending since the accused is said to be elusive for about 20 years. Accordingly, the case in P.R.C.No.100005 of 2009 of Judicial Magistrate Court, Dharapuram, Dharapuram Taluk, Tiruppur, stands closed, however, with a liberty to the prosecution to reopen the same if any clue is obtained against the accused or if the accused resurfaces against. This Suo Motu Transfer Case is disposed of.

26.09.2025 grs electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
