ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This case is registered for alleged offence under Sections 59(1) and 63 of the Food Safety and Standards Act, 2006. The incident occurred on 10.10.2017. The allegation in this case is that the accused is selling food in a open plastic cover violating the guidelines under Food Safety and Standards Act, 2006. It is stated that he is admitting the crime and submits that he is not indulging in selling such food anymore. Considering the quantity and the nature of the business and the accused has been facing this case from the year 2018, lenient view is taken upon admission. Accordingly, this Court, upon finding the accused guilty, instead of sentencing him to imprisonment, imposes a fine amount of Rs.2,000/- and the fine amount should be paid in the next hearing before the learned Magistrate.

3. Accordingly, the case in C.C.No.143 of 2018 of Judicial Magistrate Court, Dharapuram, Dharapuram Taluk, Tiruppur, stands disposed of. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
