PRAYER: Writ Petition filed under Article 226 of Constitution of India seeking issuance of Writ of Mandamus, directing the respondents to disburse the compensation amount of Rs.25,00,000/- (Rupees twenty five lakhs only) to the petitioner for his loss of son. ORDER
The petitioner herein seeks a direction to the respondents to disburse the compensation of Rs.25,00,000/- to the petitioner for the death of his son during Bull Race festival.
2. It is the case of the petitioner that on 18.01.2023, there was a
Bull Race in his Village, namely Kalnarsampatti Village, Natrampalli Taluk, Tirupattur District in connection with Pongal festival. The petitioner's son Mushraf died due to bull gore. The petitioner's claim for compensation was rejected by the ninth respondent. Therefore, the petitioner submitted a representation before the respondents 1 to 5 seeking compensation from the Government. Though the request of the petitioner seeking compensation was recommended by the fourth respondent in his proceedings dated 06.05.2023, the respondents 1 to 3 have not considered the same. Therefore, the petitioner has come before this Court.
3. The leaned counsel for the respondents 1 to 5 would submit that the competent authority to consider the representation of the petitioner is Additional Chief Secretary/Commissioner of Revenue Administration and he has not made as a party herein.
4. In view of the submission made by the learned counsel for the
respondents 1 to 5, the petitioner is directed to submit a fresh representation to the competent authority namely the Additional Chief Secretary/Commissioner of Revenue Administration, Fort St. George, Chennai, within two weeks from the date of receipt of copy of the order. On submission of the representation by the petitioner, the concerned authority shall consider the same and pass final orders within a period of eight weeks from the date of submission of the representation by the petitioner. The Registry is directed to forward the copy of this order to the Additional Chief Secretary/Commissioner of Revenue Administration, Secretariat, Fort Saint George, Chennai-9.
5. With the above direction, this writ petition is disposed of. There shall be no order as to costs.
