PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus to call for the records of the respondent relating to file No.68041/A3/2000 dated 30.10.2004 rejecting the petitioner's application for the grant of mini bus permit for the route Tirupur Old Bus Stand to Vadugapalayam Pirivu, quash the same and consequently direct the respondent to consider the application and orders passed as per the date of application (seniority list).

ORDER

I have heard Mr.P.V.Sachidanandam, learned counsel for the petitioner and Ms.A.Madhumathi, learned Special Government Pleader appearing for the respondent.

2. This writ petition has been filed seeking to set aside the order dated 30.10.2004 passed by the respondent rejecting the petitioner's application for grant of mini bus permit for the route Tirupur Old Bus Stand to Vadugapalayam Pirivu on the ground that there was no vacancy available at the relevant time in Tirupur region.

3. Though the writ petition was admitted on 23.12.2004, no interim order has been granted. By efflux of time, there is nothing for adjudication in this writ petition because the policy relating to number of mini bus permits to be granted in a region had subsequently been revised by the Transport https://hcservices.ecourts.gov.in/hcservices/

Commissioner pursuant to the orders passed by the Government of Tamil Nadu. Therefore, the impugned order cannot be set aside.

4. However, this Court leaves it open to the petitioner to apply afresh if he is so advised and the application can be entertained provided there is vacancy and in terms of the policy decision taken by the Government with regard to the grant of mini bus permits.

5. With the above direction, the writ petition is disposed of. No costs. Consequently, the connected WMP is closed.
