ORDER

This petition has been filed seeking to modify the condition in para 8(b) passed by this Court in Crl.O.P.No.28787 of 2024 dated 22.11.2024 with a condition to deposit original title deed of the immovable properties worth Rs.25,00,000/- either belonging to himself or his friends or relatives to the credit of

Crime No.16 of 2024 on the file of the respondent police.

Learned counsel for the petitioner submitted that, this Court, while granting bail to the petitioner, had directed the petitioner to deposit the original title deed of the immovable properties worth Rs.25,00,000/- either belonging to himself or his friends or relatives to the credit of Crime No.16 of 2024. The learned counsel would further submit that neither the petitioner nor his relatives or friends have any property worth Rs.25,00,000/- and in the alernative, the petitioner is ready to make a cash deposit of Rs.7,00,000/- to the credit of Crime No.16 of 2024.

3. The learned counsel for the intervenor vehemently opposes for modification of condition.

4. Heard learned counsel on either side and perused the materials available on record.

5. Taking into consideration the fact that the bail has been granted on 22.11.2024 and since the petitioner is unable to comply with the condition and the petitioner has come out with an alternate plea to make a deposit of Rs.7,00,000/- to

the credit of Crime No.16 of 2024, this Court is inclined to modify the same.

Taking into consideration the submission made by the learned counsel appearing for the petitioner, this Court is inclined to modify the condition imposed by this Court in Crl.O.P.No.28787 of 2024 dated 22.11.2024. Accordingly, Paragraph 8 (b) of the said order shall be read as follows :- "8.(b) the petitioner is directed to deposit a cash of Rs.7,00,000/- to the credit of Crime No.16 of 2024 on the file of the respondent police; and on such deposit being made, the learned Judicial Magistrate, Gingee shall redeposit the same in an interest-bearing account with any nationalized Bank. The amount shall not be released to the petitioner till the disposal of the case."

7. It is made clear that all other conditions remain unaltered. With the above modifications, this Criminal Miscellaneous Petition stands ordered. 19-12-2024 dpa/vsn
