ORDER

This Criminal Original Petition has been filed to issue a direction to the first respondent not to harass the petitioner under the guise of enquiry. 1/4

2. The case of the petitioner is that one Augustin, who is the known person to the petitioner has borrowed a hand loan from the 2 nd respondent though the said amount has been paid by Augustin, the 2 nd respondent lodged a false complaint implicating the name of the petitioner and on the basis of the said complaint, the first respondent is harassing the petitioner. Hence, this petition.

3. The learned Additional Public Prosecutor appearing for the 1 st respondent, on instructions, submitted that current paper enquiry is pending against the petitioner and the petitioner was called for enquiry and the 1 st respondent has not harassed the petitioner.

4. In such view of the matter, it is for the investigating agency to issue appropriate notice to the petitioner under Section 35(3) of BNSS for enquiry and on such notice, the petitioner shall appear for enquiry and co-operate with the investigation. If any cognizable offence is made out, the 1 st respondent shall register the First Information Report and proceed as per law. 2/4

5. With the above direction, this Criminal Original Petition is disposed of.
