D.Shivakumaran COMMON ORDER Heard the learned counsel for the parties.
2. Today the learned counsel for the petitioners states that the petitioners have already issued cheques three in number, by way of post dated cheques for clearing the entire due of Rs.12,00,000/-(Rupees Twelve Lakhs Only) by first week of March 2026. Learned counsel would therefore states that the question of payment of any additional interest component does not arise.
3. However, the learned counsel for the respondents/decree holders inviting my attention to the order passed on 18.12.2025, brings to my notice that the acceptance of Rs.12,00,000/- was only without prejudice to the rights of the respondents and therefore, the respondents are well within their rights to seek for payment of the interest component especially when they have already shown concession by reducing the interest to 15% p.a..
4. In the light of the above, both the civil revision petitions are disposed of directing the petitioners to honour the three cheques that have already been handed over to the respondents/decree holders on the respective dates on which they fall due. . That apart the petitioners shall pay an additional sum of Rs.1,25,000/-(Rupees One Lakh Twenty Five Thousand Only) in full and final settlement by 31.03.2026. The post dated cheque for the amount of Rs.1,25,000/-shall be deposited with the the respondent /Chit Company by 15.02.2026.
