J U D G M E N T

This instant suit is for the recovery of money to a tune of Rs.35,22,01,039/- along with interest 14% per annum from the defendant company.

2. Heard Mr.C.Umashankar, learned counsel appearing for the Plaintiff and Mr.M.Selvam, learned counsel appearing on behalf of Mr.P.Thirumalaivasan, learned counsel appearing for the sole defendant.

3. Today, when the applications in the Suit were listed for hearing, the learned counsel appearing on behalf of the defendant had filed a Memo indicating the admission of liability on behalf of the defendant. The said Memo had been also signed by the Director of the defendant. Further, Mr.P.Durai, the Director representing the defendant company is also present before this Court and acknowledged the liability of the defendant as against 2/4

the plaintiff and submitted that a decree to be passed by this Court.

4. In view of the Memo filed on behalf of the defendant and the oral admission made by the Director of the defendant who was present before this Court, the suit is decreed as prayed for. However, the claim of future interest alone is restricted at 6% per annum from the date of filing of the suit till the realisation of the suit claim.
