ORDER
The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 303(2) of BNS Act, 2023 (Sec-379 of IPC) in Crime No.0290 of 2025, on the file of the respondent Police, seeks anticipatory bail.
2. The allegation against the petitioner is that the defacto complainant is the Village Administrative Officer in Kattanachampatty Village was on 1/4
regular patrol over the Village was found that the petitioner was illegally transported three units of gravel soil in Government poramboke land by using Tipper lorry without any valid licence. Hence the case.
2. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.
3. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and reported that vehicle was seized which used for illegal transportation of gravel sand in Government poramboke land if. He further submitted that anticipatory bail is granted to the petitioner it would give further way to him to do similar offence. He further submitted that no previous case has been registered against him. However, he oppose to grant anticipatory bail to the petitioner.

Considering the above facts and circumstances of the case, taking note of the submission made by the learned Government Advocate (Crl.Side), the nature of allegation, and also the fact that the petitioner has illegally transported sand which causing severe damage to the ecology, this Court is 2/4
not inclined to grant anticipatory bail to the petitioner.
