CMP.No.233 of 2025 in CMA. No.SR.169449 of 2024 M.DHANDAPANI,J.

This petition has been filed seeking to condone the delay of 925 days in filing he present CMA.

2. The learned counsel for the appellant submitted that the first respondent has set ex-parte before the Tribunal. To that effect, he has made an endorsement in the case bundle. In respect of R2, Mr.S.Arunkumar, learned counsel takes notice.

3. Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay is condoned and accordingly, the petition is ordered. However, the appellants are not entitled for any interest for the delay period.

4. Registry is directed to number the appeal and print the name of the counsel, who takes notice on behalf of the second respondent, in the cause list and post the case in the usual course.
