ORDER

Apprehending arrest in connection with Crime No.955 of 2024 registered for the offences punishable under Sections 296 b, 132 and 351(1) of BNS, 2023, the present petition has been filed seeking anticipatory bail.

2. The case of the prosecution as per the defacto complainant Aruldoss,

a Personal Security Officer of the Minister of Forest is as under:- On 03.12.2024 at about 8.30 am, having come to know that the public of Arasur Village had been conducting a road roko at Chennai-Trichy Highway portraying their protest and seeking remedy for the victims of Fengel Cyclone, the Hon'ble Minister for Forest, who had been proceeding to inspect the Cyclone affected areas, had been at the spot to apprise the action taken by the Government and pacify them. During such course of action and while the Hon'ble Minister was giving assurance to the public, the petitioner/A2 alongwith A1 Ramakrishnan belonging to Iruvelpattu Village, Villupuram, had abused the Hon'ble Minister and other officers in a filthy language, hurled mud on them and thereby prevented the Hon'ble Minister and other Government officials from discharging their duty. Hence, the case.

3. Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this court. He would submit that the petitioner is a member of public affected by the flood, she had only questioned the Government officials for not providing proper relief and that a false complaint has been lodged against her. He would further submit that the petitioner is ready to abide by any stringent condition that may be imposed by this Court.

4. Per contra, learned Government Advocate (Criminal Side) appearing

for the respondent police, opposing for grant of anticipatory bail, would submit that on the date of occurrence, viz., 03.12.2024, the Hon'ble Minister for Forest, while proceeding to visit the flood affected area in Villupuram, had rushed to the spot called Arasur Village near Chennai to Trichy Highway on coming to know about the road roko conducted by the public of that locality and while giving assurance to the public that proper relief would be given to them the petitioner, who belongs to a political party, along with the other accused, had abused the Hon'ble Minister and the other Government officials accompanied with the Minister in a filthy language and wantonly slung the mud on them and prevented them from discharging their duty. He would further submit that the investigation reveals that the petitioner is not a victim of the Fengel Cyclone and thereby her action cannot claimed to be a spontaneous one on frustration, rather it could have been well planned with an intention to degrade the Hon'ble Minister and the administrative machinery of the State.

5. Heard the learned counsel appearing for the petitioner, the learned Government Advocate (Criminal Side) appearing for the respondent Police and perused the materials available on record.

6. Taking into consideration the above facts and circumstances of the case, the submissions made by the learned counsel on either side and the outcome of the investigation by the respondent, this Court is not inclined to grant

anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
