No.6603/2023 which is filed for challenging the very sale deed dated 03.11.2023 vide document No.6832/2023 by way of setting aside the sale pending on the file of the VII Asst. Judge, City Civil Court at Madras and till the finality reached in the Original Suit made in O.S. No.6603/2023 which is preferred by the Petitioner herein before the VII th Asst., Judge City Civil Court, at Madras.

ORDER
This writ petition has been filed, aggrieved by the grant of patta in favour of the 7th respondent for the property morefully described in the prayer to this writ petition.
2.The petitioner claims that she is the owner of the property and that a Civil Suit is pending, but despite the same, the second respondent has issued patta for the property in favour of the 7th respondent. The petitioner seeks for cancellation of the said patta. The petitioner had earlier given representation on 19.09.2024 to the second respondent seeking for cancellation of the patta issued in favour of the 7th respondent. Since the same has not been considered, the petitioner has filed this writ petition.
3.Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents 1 & 2. Ms.Akila Rajendran, learned Government Advocate accepts notice on behalf of the fourth respondent. They would submit that the competent authority, who has to consider the petitioner's request for cancellation of patta, is the Revenue Divisional Officer Chennai Central, Revenue Division, Anna Nagar.
4.Since the Revenue Divisional Officer Chennai Central, Revenue Division, Anna Nagar, who is the competent authority to consider the petitioner's request, is not a party to this writ petition, the Revenue Divisional Officer Chennai Central, Revenue Division, Anna Nagar is suo motu impleaded by this Court as the eighth respondent in this writ petition. 5.No prejudice would be caused to the official respondents if a direction is issued to the competent authority, i.e. Revenue Divisional Officer Chennai Central, Revenue Division, Anna Nagar to consider the petitioner's representation and decide the request of the petitioner for cancellation of patta issued in favour of the 7th respondent, after hearing the objections of the 7th respondent as well as any other third party whom the newly impleaded eighth respondent deems it fit to enquire within a time frame to be fixed by this Court. 6.This Court is not expressing any opinion on the merits of the petitioner's representation.
7.Since no adverse order is passed against the respondents 3, 5 to 7 in this writ petition, notice to the respondents 3, 5 to 7 is dispensed with. 8.For the foregoing reasons, this writ petition is disposed of by directing the petitioner to submit a fresh representation to the Revenue Divisional Officer
Chennai Central, Revenue Division, Anna Nagar seeking for cancellation of patta issued in favour of the 7th respondent, within a period of one week from the date of receipt of a copy of this order. On receipt of the said representation, the eighth respondent shall consider the said representation, on merits and in accordance with law and pass final orders, after hearing the objections of the 7th respondent and also any other third party whom the eighth respondent deems it fit to enquire within a period of 12 weeks thereafter. Consequently, connected WMPs are closed. No costs.
