Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to pay the petitioners the wages of Rs.1,02,112/-, Rs.1,07,092/-, Rs.59,649/-, Rs.99,760/-, Rs.88,984/- , Rs.1,03,664/- and Rs.41,333/- respectively towards the wages of earned leave surrendered by the petitioners while they were in service as admitted by the respondent in their reply to their RTI application and also the wages towards Post Retirement Benefit Fund with 12% interest, within a specific 1/7

ORDER
This writ petition has been filed by the petitioners seeking to direct the respondent to settle the amounts admitted under the Right to Information Act towards the Earned Leaves surrendered by them and also to pay the Post Retirement Benefit Fund dues, along with 12% interest per annum.
2. Mr.Vinoth Raj, learned Standing Counsel takes notice on behalf of the respondent. In view of the consent expressed by the learned counsel on either side, this writ petition is taken up for final disposal at the admission stage itself.
3. It is the case of the petitioners that they joined the services of the Respondent Corporation under various categories and were made permanent after completing 240 days of service and they subsequently retired from service on various dates, on attaining the age of superannuation. While so, 2/7
though the petitioners surrendered their earned leaves, the respondent has not settled the amount payable towards those surrendered earned leaves and the petitioners were also not paid with Post Retirement Benefit Fund Scheme dues. Hence, the petitioners made applications under the Right to Information Act, seeking information regarding the dues under the Earned Leaves surrendered by them. In response to the said applications, the respondent, vide respective communications admitted that certain amounts towards Earned leaves surrendered by the respective petitioners are not settled in their favour.
4. Despite acknowledging that the petitioners are entitled to the certain amounts towards earned leaves surrendered by them, the respondent has not come forward to clear the dues. Hence, the petitioners sent representations on various dates in this regard, however, the same evoked no response. Hence, the present writ petition has been filed by the petitioners, seeking to settle the amounts admitted under the Right to Information Act towards the Encashment of Earned Leaves surrendered by them and also to pay the Post Retirement Benefit Fund dues, along with 12% interest per annum. 3/7
5. Heard the learned counsel on either side and perused the materials available on records.

On perusal of the papers, it is evidently clear that the petitioners are entitled to the amounts as admitted by the respondent under the Right to Information Act towards the Earned Leaves surrendered by them. Therefore, a mandamus is issued to the respondent to settle the amounts, as admitted under the Right to Information Act, towards the encashment of earned leaves surrendered by the respective petitioners along with 6% interest per annum and also pay the amount due towards Post Retirement Benefit Fund, if they are entitled to, along with 6% interest per annum, in favour of the respective petitioners, from the date on which the amounts became due and payable till the date of actual disbursement of the same to the petitioners, within a period of eight (8) weeks from the date of receipt of a copy of this order. It is made clear that if the amounts are not paid within the time frame fixed by this Court, it will fetch interest at the rate of 9% p.a. from the date on which the amounts became due and payable till the date of actual realisation. 4/7
7. With the above observations and directions, this writ petition stands disposed of. No costs.
