1294, 72nd Street, Korattur, Chennai 600 080, Tamil Nadu Housing Board Korattur Scheme, comprised in Survey No.816/2B, Korattur Village, Ambattur Tk, now Chennai Dt to and in favour of the appellants and further direct the 6th respondent to permit the appellants to withdraw compensation of Rs.26,55,199/- deposited towards the acquisition of part of Plot NO.

Mr.P.Harish, Government Advocate [RR1 to 4 & 6] Judgment (Judgment of the Court was delivered by R.Suresh Kumar J.) This intra-court appeal in fact has been filed against the order passed in Rev.Applw.No.162 of 2025 dated 10.07.2025. The said review application was filed against the order passed in W.P.No.36434 of 2024 dated 22.01.2025.

It is brought to our notice by Mr.Balan Haridas, learned counsel appearing for the appellants that as against the order passed in W.P.No.36434 of 2024 dated 22.01.2025, an appeal has been filed, which is at the S.R. stage in W.A.Sr.No.157299 of 2025, since there is CMP for condoning the delay in C.M.P.No.28711 of 2025 is pending.
3. In view of the said factual position, where the present appellants have already chosen to file an appeal against the main order i.e., order passed in W.P.No.36434 of 2024 dated 22.01.2025 and the said appeal if it is decided in one way or other, nothing would survive in the present appeal as it is only an offshoot of the review application.
4. In that view of the matter, while dismissing this writ appeal for the aforesaid reason, liberty is given to the appellants to pursue their writ appeal in W.A.Sr.No.157299 of 2025 and if that appeal is taken up and decided, the order to be passed in the said appeal will cover the issue raised in this appeal also.
