Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus, directing the 3rd respondent to conduct an enquiry and to dispose the Appeal filed in appeal No.E/1469270/ 2023 dated 01.11.2023 within a stipulated time as fixed by this Honble Court.

The writ petition has been filed for issue of a writ of mandamus directing the respondents 1 to 5, particularly third respondent to conduct enquiry and dispose of the appeal that is pending in Appeal No.E/1469270/2023 dated 01.11.2023 within a time frame fixed by this Court.

2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents 1 to 5.

The sixth respondent has filed an appeal before the third respondent and the third respondent passed an order on 15.06.2023 remitting the matter back to the file of the fourth respondent to pass fresh orders. The grievance of the petitioner is that the fourth respondent without conducting proper enquiry passed orders on 03.10.2023 and cancelled the patta that was issued in respect of the subject properties. In view of the same, the petitioner's vendor and the petitioner preferred an appeal before the third respondent which was taken on file in Appeal No.E/1469270/2023 dated 01.11.2023. There was no response and hence, the petitioner submitted a representation dated 08.03.2025 and the same also did not evoke any response. Even though summons was issued on 29.05.2025 calling upon the petitioner and others to attend the enquiry, no final orders were passed. It is under these circumstances, the present writ petition came to be filed.
4. Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the third respondent to deal with the appeal pending in 3/5
Appeal No.E/1469270/2023 dated 01.11.2023 on its own merits and in accordance with law, after affording an opportunity of hearing to the petitioner and the sixth respondent and final orders shall be passed within a period of six weeks from the date of receipt of a copy of the order. The Writ Petition is disposed of with the above direction. There shall be no order as to costs.
