(Order of the court was made by S.M.SUBRAMANIAM, J.) This miscellaneous petition has been filed to condone the delay of 165 days in filing the above writ appeal.

The learned Counsel appearing on behalf of the respondents raised an objection by stating that the petitioner has not explained the delay sufficiently.

However, this Court find that the delay cannot be construed as uncondonable.

Therefore, in view of the reasons stated in the accompanying affidavit filed in support of the petition, delay is condoned and this miscellaneous petition stands ordered.
