Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, seeking to quash the impugned order passed by the 4th respondent vide NI.Mu.No.2357/2023/A2 dated 15.03.2025 and directing the third respondent not to conduct any enquiry based on the appeal filed by the 5th respondent dated 29.04.2025 as per the guidelines in W.P.No.9215 of 2013 vide order dated 23.10.2017 and circular Ref No.K3/27160/2018 dated 13.03.2018 issued by the 1st respondent. 2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents 1 to 4 and perused the materials available on record.
3. It is seen that aggrieved by the order passed by the fourth respondent dated 15.03.2025, the fifth respondent filed an appeal and it is pending before the third respondent.
4. The learned counsel for the petitioner would submit that already in respect of the subject property, suits are pending between the petitioner and the fifth respondent. Therefore, the third respondent may be restrained from disposing the appeal.
5. A perusal of records revealed that though the civil suits are pending, the third respondent is not going to decide the title over the property. The request made by the fifth respondent for deleting the names of some persons from the patta in respect of the subject property was rejected. Aggrieved by the same, the fifth respondent filed an appeal.
6. Therefore, the third respondent can very well deal with the appeal and dispose of the same, on merits and in accordance with law. It is also made clear that the third respondent can also consider the suits which are pending between the petitioner and the fifth respondent, while disposing the appeal.
