Respondent PRAYER: Criminal Revision Case is filed under Sections 438 & 442 of BNSS, praying to call for the records relating to the judgment dated 10.12.2020 made in CA.No.19 of 2020 on the file of the Principal District and Sessions Judge, Namakkal confirming the conviction imposed in the judgment dated 29.11.2019 made in STC.No.25 of 2017 on the file of the learned Judicial Magistrate (FTC), Tiruchengode and set aside the same by allowing this criminal revision petition.

O R D E R

This Criminal Revision Case has been filed against the judgment dated 10.12.2020 made in CA.No.19 of 2020 on the file of the Principal District and Sessions Judge, Namakkal confirming the conviction imposed in the judgment dated 29.11.2019 made in STC.No.25 of 2017 on the file of the learned Judicial Magistrate (FTC), Tiruchengode. 2.

Heard, the learned counsel appearing on either side and perused, all the materials placed before this Court.

The petitioner is the accused in the complaint lodged by the respondent for the offence punishable under Section 138 of NI Act. After full-fledged trial, the trial court convicted the petitioner for the offence punishable under Section 138 of NI Act and sentenced him to undergo six months simple imprisonment. He was also ordered to pay compensation to the respondent to the tune of the cheque amount. Aggrieved by the same, the petitioner preferred criminal appeal. However, the appellate court dismissed the criminal appeal confirming the judgment of the trial court. Aggrieved by the order of the appellate court, this criminal revision case has been filed. 4.

Pending this criminal revision case, the petitioner has settled the

entire cheque amount to the respondent. Today, the petitioner and the respondent appeared before this Court. The respondent deposed that he received the entire cheque amount and he has no objection to set aside the impugned judgments.

In view of the above, the judgment dated 10.12.2020 made in CA.No.19 of 2020 on the file of the Principal District and Sessions Judge, Namakkal and the judgment dated 29.11.2019 made in STC.No.25 of 2017 on the file of the learned Judicial Magistrate (FTC), Tiruchengode, are set aside. The petitioner is acquitted of all the charges for the offence under Section 138 of NI Act.
