Challenging the order passed in Crl.A.No.24 of 2017 dated 20.12.2018 on the file of III Addl. Judge, Salem, the petitioner preferred the above Criminal Revision Case, however there is a delay of 1711 days in representing the above Criminal Revision Case arose. Hence, the present petition has been filed to condone the delay in representing the Crl. R.C..

2. Mr.B.Sundarapandian, learned counsel for petitioner submitted that though the above Revision Case was filed within time, due to earlier counsel engaged by the petitioner was died and due to Covid-19 pandemic situation, the above petition was not represented within a stipulated time. Therefore, there is a delay of 1711 days arose in representing the above second appeal and the said delay caused is neither willful nor wanton, but for the above said reasons. Accordingly, he has filed the above petition.

3. Considering the facts and circumstances and on considering the reasons stated by the petitioner in the affidavit that the counsel engaged by him was died as well as due to Covid-19 pandemic, it was not represented within a stipulated time, which seems to justifiable one and to give one more opportunity to the petitioner, this court is inclined to allow this petition. Registry is directed to number the above Criminal Revision Case if it is otherwise found to be in order.
