ORDER
The petitioner seeks transfer of HMOP No.770 of 2024 pending on the file of the II Additional Family Court, Chennai to the file of the Family Court, Vellore, Vellore District.
2. The learned counsel for the petitioner submitted that the petitioner have two minor daughters and finds it difficult to travel from Vellore to Chennai, is more than 200 kms. Further she is residing in her parents' house along with her child and has no independent source of livelihood. Hence, she seeks transfer of the case to the Family Court, Vellore.
3. Considering the submissions made by the learned counsel for the petitioner, and upon perusal of the materials available on record, this Court finds that the reasons stated to be justifiable and is inclined to allow the transfer petition. It is seen from the records that notice was already sent to the
respondent. However, the respondent refused to receive the same. Such refusal amounts to due service of notice. Therefore, no further notice or substituted service is necessary.
4. Accordingly, HMOP.770 of 2024 pending on the file of the II Additional Family Court, Chennai, is withdrawn and transferred to the file of the Family Court, Vellore.
5. The II Additional Family Court, Chennai, is directed to transmit the case records to the Family Court, Vellore, within a period of three weeks from the date of receipt of a copy of this order.
6. Upon receipt of the records, the Family Court, Vellore, shall issue notice to the respondent and thereafter proceed with the matter in accordance with law and dispose of the same as expeditiously as possible, preferably within a period of four weeks from the date of receipt of the case records.
7. Accordingly, this Transfer Civil Miscellaneous Petition is allowed. Consequently, the connected miscellaneous petitions are closed. No costs.
