C. Shanmugam namely (1) S. Vetrivel (2) S. Thenmozhi, (3), S. Shanthi and (4) S. Geetha, conduct fresh enquiry and include the Petitioners S. Shanmugapriya in the legal heir certificate as the daughter of the 2nd Wife of Mr. C. Shanmugam died on 27.08.2024.

ORDER

This petition has been filed seeking a direction to the respondents to cancel the legal heir certificate issued by the 3rd respondent No.TN720240916241 dated 03.10.2024 in favour of children of the 1st wife of the petitioners father Late C. Shanmugam namely (1) S. Vetrivel (2) S. Thenmozhi, (3), S. Shanthi and (4) S. Geetha, conduct fresh enquiry and include the Petitioners S. Shanmugapriya in the legal heir certificate as the daughter of the 2nd Wife of Mr. C. Shanmugam died on 27.08.2024.

2. It is the case of the petitioner that the petitioner is the daughter Late C.Shanmugam and his second wife. The legal heir certificate has been issued including the name of the first wife and her children of Late C.Shanmugam, Hence, the petitioner made a representation to the respondents to conduct fresh enquiry and include her name in the legal heirship certificate as daughter of the deceased C.Shanmugam and the same was not considered. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Special Government Pleader appearing for the respondents submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the 3 rd respondent to consider and pass orders on the petitioner's representation dated 27.02.2025 within a period of four weeks from the date of receipt of a copy of this order.
