The petitioner/accused in Crime No.1 of 2024 for offence under Section 7 of the Prevention of Corruption (Amendment) Act, 2018 r/w Section 102 of Cr.P.C., had filed this petition seeking to quash the F.I.R. 2.The contention of the learned counsel for petitioner is that petitioner is holding a post of Sub Registrar for more than 25 years. She joined duty on 20.10.1999. The District Inspection Officer along with his team on 20.05.2024 conducted a surprise check in the Sub Registrar Office-II, Villupuram, at that time, the Document Writer and others were detained. During surprise check an unaccounted cash to the tune of Rs.1,80,040/- seized from various places and various persons. As regards the petitioner, only an amount of Rs.4,190/- being her personal amount, which was kept in 2/6
her money purse, was found and no other cash was found from her. From others cash was seized, they had given explanation but the District Inspection Officer and the respondent police failed to consider the same and registered the F.I.R. On 30.06.2025, the petitioner retired from service. Due to the pendency of the above case, her terminal benefits not released, hence, filed the above petition.
3.The learned Government Advocate filed a status report submitting that on 20.05.2024, the District Inspection Cell officer conducted a surprise check at the office of Joint Sub-Registrar-II, Villupuram along with Deputy Superintendent of Police and other officials of Vigilance and Anti-Corruption Department. During surprise check a sum of Rs.4,190/- seized from the money purse of the petitioner and some other cash seized from Data Entry Operator and private persons such as Stamp vendors and others. From the top of the Iron bureau an amount of Rs.82,000/- seized but no explanation given. Totally, a sum of Rs.1,80,040/- seized. He further submitted that on 3/6
conclusion of investigation, now it is recommended for Tribunal action against the petitioner. In view of the same, the petitioner's prayer in the above petition becomes infructuous.
4.Considering the submissions made, it is seen that now investigation completed and the Director of Vigilance and Anti-Corruption, Chennai sent the final report to the Vigilance Commission on 06.02.2025 recommending for taking Tribunal action against the accused. Hence, quashing of F.I.R. would not arise.
5.In view of the same, the Criminal Original Petition is dismissed. Consequently, the connected Criminal Miscellaneous Petition is closed. 04.04.2025 (1/2) Index : Yes / No Internet: Yes/No Speaking / Non-speaking order rsi 4/6
