This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 57 days in filing the above Criminal Revision Case against the order dated 15.04.2025 passed in C.M.P.No. 1120 of 2024 in M.C.No.47 of 2023, on the file of Family Court, Erode.
2. Mr.M.Guruprasad, learned counsel for petitioner submitted that on receipt of certified copy of order on 24.07.2025 only and after arranging necessary fee and expenses, the petitioner is able to instruct counsel on record to prefer the above Criminal Revision case only during month of September 2025 and thereafter, he gave papers to him, as a result of which, there is a delay of 57 days in filing the above Criminal Revision Case arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Criminal Revision Case.
3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition.
